Safe Harbor Rules for Disclosure of Employee Benefit Plan Information

The Internal Revenue Service (IRS) issued proposed rules under the Employee Retirement Income Security Act of 1974, as amended (ERISA), concerning the disclosure of certain employee benefit plan information through electronic media and standards for the maintenance and retention of employee benefit plan records in electronic form.

On April 9, 2002, the DOL’s Pension and Welfare Benefits Administration (PWBA) issued final safe harbor rules for disclosure of employee benefit plan information to participants and beneficiaries, as well as rules regarding the maintenance and retention of employee benefit plan records in electronic form.  Prudential has published a summary of this rule.
